Recovering uninsured losses

Extent: Jersey
Updated 30 May 2019
---------------------------------------------------

What are uninsured losses

1 Any loss which a client suffers as the result of an accident which is not covered by their insurance cover.

These could be:

  • Damage to vehicle (where insurance is third party, fire or theft)
  • Insurance excess
  • Car hire expenses
  • Travel expenses
  • Loss of earnings
  • Personal injuries
  • Consequential loss eg where damaged car is subject to a loan agreement and the write-off value is less than the outstanding amount on the loan.

How to recover these

2 Many clients will have 'legal protection' cover as part of their insurance policy. This provides a recovery service for uninsured losses where the other party has been shown to be responsible for the accident.

3 If the client has no legal protection, the only recourse is to take legal action for recovery from the other party. Legal advice should be obtained. See 4.2.2
